I have 6 containers coming in to India from Europe. 2 are on APL and 4 on Hapag. Though Seaway B/L's for all the 6 were issued by the forwarder origin office & emaild to me but now shipper is trying to take control of shipment by asking for the Original B/L from the forwarders office in europe. The terms were ex-works and so the shipment has been completely arranged by me from India.

Can shipper now ask the origin office to hand him over the B/L where initially he ordered the Seaway B/L in the first place????

Can he take control of the goods through any other means??

Is the forwarder origin office under any obligation to surrender the B/L to the shipper??

If you did not got the orginal B/LS ,copy is not accept by the carrier,  you can not control the cargos.

if your b/l is a seaway bill, that means you don't need to present original B/L when picking up the containers, you are the one to control the containers. Problem is that if the B/L is really a seaway bill? or only a seaway bill draft? If your supplier already instruct the forwarder to issue seaway bill, then you can control the shipment, if not, the forwarder will need the instruction from your supplier to issue seaway bill or original B/L.

ask the shipping agent to send you the instructions who the shipper sent him to issue a seaway BL. i think you are the only one who be able to control this shipment especially in case the BL issue was done.
