Hi all,

I have a shipment worth over 50k USD that is being shipped from China to the US. Apparently US regulations state that this product cannot be imported into the United States due to emissions standards. The manufacturing agent assured us that the shipment is okay to be shipped to the US, but apparently not because it is now stopped by customs in China.

This has never happened before. What should we do now? In these instances, if the shipment is stopped by Chinese Customs, will the shipment be destroyed? Or will it be returned back to manufacture?

Any help would be GREATLY appreciated.  Is there anything that we can do on our end?

if the emission standard is ok in China, then the shipment should be returned to the manufacturer, the customs will not destroy it, but it could cuase a little fee if the shipment goes back to the manufacturer.

Good luck!

Sorry to hear that, if I deal with this job, I will not take such a big risk.

Is the goods concern about a copy of brand? if they are copy items, custom would destroy the goods.

Anyway, it depends on what kind of items, and what problems with it. I can not give you the exact solution unless I know what problem with your goods.

There are brand name rules in Customs inspections that must be followed that have to do with the copyright and trademark laws of the United States, it would be caught here and they would want documentation verifying that they are truly the product manufacturer. You do not need to prove that you are an authorized dealer. However, this sounds typical of a foreign customs house. In Mexico also this tactic is common. They truly are probably holding the goods hostage.

In the U.S.A., emissions standards are managed by the EPA. Are you dealing with auto parts or generator?
