3-12 day lead time extends to 50+ ...legal action?

I have a supplier whos establishment is registered in USA who I am having problems with.

I have 25K with him and his lead time was 3-12 days. Lead time has extended to 50+ days.

Through the forums I have found 4 others who are out 10-50K and some of them have had money out for 120 days.

He has cost us lost business from long term customers, money out for a long time, relapse of CC billing cycle as well as FALSE terms.

We were told items were in FL sitting on a pallet so we sent money. Come to figure out, the he doesnt have the items. He went to India to get them 2 weeks later and still no word. Have been given a fedex tracking number and told they would be sent last Friday, when my inside information has told me they have not even arrived on the dock.

My question is,
1) is this a case that we can get a judge to even give us a court case?
2) What would you call such a suit?
3) What type of re compensation if any could we expect in a court case settlement?
4) Any other information or referrals to any lawyers with this kind of experience would be great.

He is based out of Georgia. It would be one thing if some things came up, but it looks like he has been giving 5+ people false lead times when he knew he could not provide or did not know exactly when he would have them in.
