Copyright of design when dealing with manufacturers

Great you have you design ready for your jacket, pants, shirt etc now you need to find a manufacturer with good quality, nice price, nice service etc.

I found out the hard way that you can´t have it all - I prioritise quality and A+ service before price - which means I do not take the cheapest.

Regarding your design (does not matter what if it is shirt or pants) - when dealing with manufacturers abroad, how do you tackle the design issue? - the manufacturer might use you design and sell items to other importers in different countries.

Do write an document? Do you register the design in your country/few countries etc?

What are your thoughts ideas!

Hi Peter,

To pretect your design is to ask your supplier to sign the DNA agreement before expose your design to them,if you need, I can send you the format, that means that they agree on not expose your design to a third party.

I am acting as an buying office for people, if you need, I 'd be happy to work together with you.

I am a designer also and have the same problem....maybe is it possible to get such document copy from you. And in what way are you coloborating with manufactures, when you are selling your designs. Thanks for the answer....

It is quite difficult solve the problem. Before open my factory I was a wholesaler who imported from China... and I had many problems.

1.- When you ask for quotations you have to show your items to many factories, some of them will use them in the future or will offer them to other costumers to let them think they are very good designing

2.- You will die alone but you will share in the success. It means, if your desing is bad... is your problem but if your design is the best one your own supplier wil copy, resell to other importers or the chinese market.

3.- Unusefull contracts. I have already 3 years in China and lots of experience. Normally nobody respect contracts... but, if they do, as one chinese friend I have, when they get the product everybody want to buy but one contract stop them, they just have to open a new factory in the next street... and start to produce it with other company name.

4. Refused orders. If some part of your order does not reach 100% of the quality you negociated... you think they will destroy? Maybe they will repeat or maybe they will not it depends how honest is your supplier or how many orders he thinks he can get from you... but something is clear, your refused order will be sold in the stock market in very low price. Your brand name, will be sold in bad quality (that's why you refused it) in the markets.

That's why I opened my own factory.

I was tired to do business in this way.
