HELP!! will it be dangerous ?
Post 1 of 8

We have sing a contract with one customer ,and they pay only at around 15% deposit ,but in fact ,at the contract ,they should pay 30% deposit .

And recently ,there is a money decrease 55% at their country according to USD...so what should we do ?

Is it dangerous that we finish their order ? they delay the color box design to us ,and it lead our cautions ...

Who can analysis this suitation ?

You said you have a contract. I think the contract includes all conditions, so if your buyer does not pay the deposit as agreed in the contract, you are not obliged to stick to it either.

If I were you I would first politely remind them on the correct amount of the deposit, and if they are not paying the rest, I would send them back their original deposit and quit the contract. It is possible that they should like to cancel their order because of the financial crisis. You can clear this very quickly and then start or stop production according to the results.

Concerning the currency, the currency in the contract (USD in your case) is valid for the transaction so in this respect you have nothing to fear (unless the USD-RMB rate changes dramatically which is not very likely) .

One of the purpose of the deposit is for supplier to have enough fund to purchase the material. If the deposit that your customer paid is not enough to buy the material and your customer violate the contract, you have all the reason not to further proceed the order.

However, I suspect that is miscommunication between yourself and your customer. If your customer is not an English speaker. He/She might not understand you well enough. No offense, your post here is written in broken English. I suggest you to talk to your customer more, perhaps you can find out the reason why there is a shortage of the deposit.

BTW, which currency depreciate with USD that much recently?

When you sign a contract with your customer, it means both of you have to keep it.

Accroding to the contract, the deposit should be 30%, while your customer had just paid 15%. First you should inform him the right amount so that you could keep the contract.

Meanwhile, your customers did not confirm the details of packing, and it bring out some questions. I think you should inform it at the earliest date so that it would not occur greater loss.

Your customer will notice these two things and give you a reply, either keep or cancel the contract. Then you know what you have to do.

Please pay attention that email may be blocked or missed duriing delivery, you should call him and make sure your customer understand this question.

Hope you could receive news soon from your customer.

You, you are skipping the steps. Why bother asking other people instead of clearing with your counterpart? You better ask your buyer, what's wrong with the deposit. And I believe no manufacturer or seller will not continue their responsibility until the buyer is fulfill according to the clause of the contract/agreement.
