I am today .. REALLY ANGRY about this !!!


I am a trading staff working in a company , i have much experience in handling a trade as i 've been working in this field for 9 years, my wife often meets some troubles in trading and she usually asks me for help , but today , it's all because of her order as I've arranged the goods , both in quality control and inland delivery , and then , my shipping agent went on to deliver my goods . And then , what a terrible situation... : when the tackle gets up the goods to put them on the deck, it suddenly falls off ,and gone with the sea.


But , who can give back my goods ?


That costs me 76134.91, including all fees from my ***** shipping agent!!

Hi!

As i am unable to reconcile as to real 'back-ground' info on this mishap, can you please let me know:

1) If the container was loaded and if so whether or not the respective B/L was issued by the concerned shipping Agent;

2) If the Marine Policy was already issued and if so whether or not the Premium was paid as according to International Law for a Marine Insurance Policy to be valid, the premium amount has to be duly paid in advance and receipt thereof obtained ;

3) If you have been officially notified by the Carriers of this mishap?

4) If you have lodged a claim on the Insurance Company or not? 

5) If a Joint Survey was held and Survey Report obtained;

6) According to the Maritime Law in vogue, you have to first lodge your claim with the Shipping Company and than you can settle your claim with the Insurance Company (the underwriter's) under a letter of 'subrogation' within a max period of 1 year from the issuance of a 'short-landing' or 'non-receipt of goods' at the discharge port....If the claim is not settled within a max period of one year, than a suit (claim) has to be filed in a court of civil jurisdiction at the port of discharge discriminated in the Bills of Lading (B/L)....

Here, it would also be pertinent to know if the shipment was effected under a letter of Credit (L/C) and whether or not same was negotiated???? If the L/C was negotiated than the beneficial right of 'OWNERSHIP' would rest with the Importer/Consignee named in the B/L.....

If the B/L was not negotiated and you still hold the vested 'right' in the consignment than you should immediately proceed with the lodging of your claim officially as herein above mentioned....

was the shipment of the goods insured before loading on the ship.  if it is insured, was it insured from warehouse to warehouse  or port to port .  if it is insured then, u can claim the loss from the insurance company.

Sorry to hear this, accidents do happen, you just file your Claim on the shipping company, as they are responcible for your Cargo until it is delivered.
