Domain Name Registration Scam - SK International Holdings & Asiadm.org.cn

I have just been approached by a domain name hosting company, SK International Holdings, who trade also as www.asiadm.org.cn, who advised that an unknown company, ALBIGENS INTERNATIONAL HOLDINGS, had been trying to regsister 9 different domain names, all with my company's name but with different country codes and that they were also registering my company's name as a trade mark.

It is not practical or financially viable to register domain names for your business in every possible variation, for every possible country, which is why I understand international law prevents anyone from registering your trading name for their own gain.

Rather than a genuine attempt to prevent extortion and fraud this is another scam to get companies to register names that they have no need of, with a company which they would never deal with either...

I can categorically state that we have no knowledge of the company you mention - Albigens International Holdings - and neither they nor any other company or party have been authorised to register domain names for us, or other names, including trade marks, which could be related to our company.
 
I understand that International Law prevents anyone from the registering of domain names and trade marks to be used as ransom and would request that you do not process these applications, as by doing so you and your company would become party to this breach of International Law and likely to be subject to recovery proceedings for damages. If the applications are processed you can rest assured that legal action would be taken to protect this company and its interests world-wide against all parties involved.
 
Please come back to me immediately with confirmation that these domain registrations and trade mark applications have now been terminated. Please also forward to me all the details you have of the applicant and their company in order that we can take the appropriate action and inform the appropriate authorities.
 
For the record a copy of this message is also being sent to you by fax.

Thanks for your reply.  If you have no relationship with them. According to our working experience, there are 3  possibilities:




1. Albigens  company is a domain name investment company, they want to register these names before you and sell back to you to  gain profits.




2. It may be a commercial method, Albigens  company is consigned by your competitor to register, make your clients confused.




3. Albigens  company may use your brand to do business in asia pacific district.
 
In addition, as a registrar in Asia, we must keep commercial secrets for applicants(including applicant name, email, telephone,business activity), for example, if you register these domain names through our body, we will not let the third party know your documents. Hope you can understand.
 
But because domain name takes open registration, this is international domain name registration principle. So Albigens  company or every other third party all has right to register it. As a domain name registrar, we have no right to  dispute their application. So required by our government  to inform your company to protect your interest. 
 
If you think their registration will confuse your clients and harm your profits, we can send a dispute application form to  you and help you register these within dispute period. I think maybe this is the best way to prevent domain name grab. But if  you don't think their application will affect your company, you can give up, we will finish their registration.Hope get your  decision ASAP, so that we can handle the next step.

There is certainly a need for us to protect our company's interests and dispute the validity of this application which can only be for either fraudulent purposes or for extortion.
 
We dispute their application as this will most certainly confuse our clients and definitely harm our profits.

The form you have sent is not a dispute resolution form but merely an order for the application for the names which are in dispute. I have no need of these names which is why we have not registered them previously, indeed if we were to register them we would use our existing domain hosting company.
 
In view of the fact that you have not indentified the company which is allegedly trying to register these names, and the fact that I can find no evidence of that company's existence, I have to assume that this is just a rouse to try to get us to register names with your company, names that we do not want and which are of no use to us. Indeed further research indicates your company and website name are listed under the heading of "Web-Name Scammers", so my suspicions would seem to be vindicated by the experience of others. 
 
We will not be buying these names, but if you do provide these to an organisation other than ourselves then please be prepared to become involved in legal proceedings to protect our interests.

Yes this is an ongoing scam but a quick google check will make anyone find out who they are. They are not even smart enough to modify the contents, they just change the destination company domain name. Here is another blog post about those scammers:

Which is exactly why CNNIC needs to do something to combat this problem, this email was sent to them today and will remain on here until they do something about it.

Dear CNNIC

There are numerous online reports of China/HK based company using multpiple websites (I believe close to 100 fake sites) that are being registered under false pretences.

One such site is asiadm.org.cn details of registration can be found here http://whois.domaintools.com/asiadm.org.cn this person has 91 domains which I am sure you can check.

The attached email shows an example of how they operate.

So far todaynic.com and dns.com.cn have been proactive but the public cannot be expected to do this by themselves. todaynic.com has said they can only close the sites down if reports are made individually and dns.com.cn has lock&hold the sites I have provided along with supporting emails.

And there are other blogs helping solve this but we believe China Internet Network Information Center (CNNIC) needs to be more proactive in catching these scammers before it gets out of control like Nigeria.

I am going to post this email to CNNIC on Alibaba until I get a plausible response from your group on what you are doing to combat this problem.

Many thanks for your input with this one, sadly all too often the authorities that are supposed to be there to help prevent fraud and scams such as this do absolutely nothing about them, despite having plenty of evidence on which to act. I write based on personal experience about other Chinese based scams.

All that we can do, to help protect ourselves and others, is to publish these examples in the hope that anyone similarly approached will "Google" the details and find postings such as these. May I please urge all who have been approached by what they consider to be a scam, of any sort, to publish details of it on this site, and anywhere else that they can, in order to maximise the coverage and help prevent others from becoming victims. 

Only this way, without far more action from the authorites which we know that we cannot rely upon, will we be able to keep these scams under some sort of control. They thrive on ignorance, the ignorance of the victims knowing nothing about the scam process; we have to keep publishing all of the details.  Many thanks to all for your help.
