The Chinese Comapny Owed me 7000$ but Refuse to Return

Dear all, I need your help and I really don't know what to do and do not want to go to the court on this stage.


I came across an interesting situation:

I arranged a dilivery (I don't say that chinese manager always was confusing details, forgot the number of contract and wrote another number in invoice and certificate of origin, so due to his "professionalism" I've been waiting for delivery for 3 weeks) ).


Ok, no problem) Then on custom there was a removal of 6 bags, because of its unsuit conditions for reload. The matter is that I've already payed all the sum but becasue of this removal the chineese comapny owe me 7000$ which it refuse to return, telling the lamest excuses I ever heard.


The question is: Is there any authority in China where can I complain on its careless actions. Like Trade Organization or smth. like that. If you can help, write pls. its contacts.

Freakly speaking,we can not grasp your meaning clearly.Just get an appoximate meaning,you said the chinese manager misunderstund you about the contract No. on invoice,I am afriad maybe you expressed wrongly to them.Same as  most of people here can not understand you clearly.

For this case,there are three reasons for goods missing:

1.supplier sent you short qty.you may ask them to send you photo when loading the goods if it were a full container.Most of sellers will take photo and marked to avoid goods missing on transportation or cusoms clearance.

2.as memtioned above,it is possible to miss on transportation.

3.when clearing from china and russia customs,they may pick up some goods for inspection,but not put them back.

When you open the door of container,pls compare the photo which your factory send to you,whether the photo is same as what you see or not?

Making sure the problem and never make such bad  conclusion before doing any surveys.

I am sorry to hear about your situation.  Can I make sure what you means ?Please confirm then I might be able to give you some tips.

1. The official on your custom moved your 6bags goods when you was clearing your delivery ,right?  The reason to move 6bags goods was only the paper problem(the information in the invoice and in the certificate of origin was not consistent with the goods your custom official saw),right?

If my above explaination is correct, then it was the supplier's fault due to they didnot provide the right documents to you. You might ask the surpplier to send you another 6bags goods for your loss or give you some amount due to you was fined by your custom.   

For us, if  a mistake were make by our staff  which had caused our buyer loss , we would make up for it before our buyer asked for it. 

2. If the reason for removal of 6bags was only the unsuit conditions for reload, then you should make sure if you had told your supplier about all the related conditions when placed the order.  If you didn't told your supplier, you supplier wouldnot know it.

Anyway, I learned something here. As professional chinese manufacturer, we are better study more custom regulations of different country.

It's a normal situation for Russian custom, you are lucky not having experience in dealing with Belarusian custom. Chinese court won't help you. There is only one way: learn the situation completely and do not make such mistakes.
