i have just recieved an email from a supplier i would like to work with , should i be wary about anything?



1) can you supply me with eu certification for your goods?
it could offer you only after we got your order. becuase we need protect our certificate.


2.) are you the trading company or the manufacturer of these products?
we are factory which producing construction machine from parts to whole machine, the garden tool we buy from other company. because some our customer believe us , and ask me purchase for them.


3.) i need to be sure your products are legal and safe for import to the uk so if you can provide me with as much information as possible i would be very greatful.
to tell you truth, we have not export to UK before, but have customer in germany , italy, greece,and russia. however, we'd like to know if UK have special requirment about import.


4)do you have any references or certificates to prove your company quality?
yes, we have CE cetification that issued by holland laboratory.


5)do you have proof you are a legitimate company?
please check the attachment , that's our license of export.





the above questions are what i sent the supplier and the what he replied, i am a little bit wary what he sent me and need to be sure on what to do as i am very new to the export sector,

Thats a bogus statement from a manufacturer.  No one is going to send money for a product that is not certified.  Besides that all they need do is give you the name of the company that certified the product and you can contact them directly about the Cert's based on the company name trying to sell the products.  If the company is not listed by the certifier than you have your answer.  If the name does exist you can question the certifier about the types of goods certified.  In any case registration numbers belong to specific companies.  If another company were to use the registration number of that company, its easy to check if that product is actually certified by the company claiming to be manufacturing it and another reason why the marking certs are authentic to the named manufacturer.

If the registered capital on their "Trust Pass" page is below RMB 3,000,000 they are no manufacturer.  RMB 500,000 is a wholesaler/distributor  RMB 100,000 is a trading company/retailer.

Germany and Italy are part of the EU

Even retailers can get a license to export, it doesnt mean they are a manufacturer

i thank you once again ranger for answering my questions, im stuck on what to do though, pretty new to importing, duties, shipping terms etc im worried i will order and i lose out on money, my first order is a trial order only $10,000 usd but next orders from the right supplier will be larger orders  $50,000 - $ 100,000 usd



can the customs and excise confiscate the items if they dont have certificates?


what certification do i need to bring products into the uk?


what will i have to pay in duty in the uk?


how do i find the best suppliers?


what is the approximate cost per container or how ever it is worked out?

A lot of the questions you are asking are product specific. What product/s are you talking about?

The UK standards on many products are much more stringent than in other countries around the world and in the EU. I recommend that you look into that yourself within country specific resource back home. That way you can be sure that you get the most correct and up to date answers.

Jamesy, under EU law you need much more than than just the CE certificate of conformity issued by the Dutch lab you mentioned. EU law provides that the certificate of conformity is just one small part of the "Technical Construction File" which must be held on EU territority either by the importer or by the 'Authorised Representative" of a non-EU based manufacturer.

That TC File must contain the entire product design drawings as well as ABSOLUTE TECHNICAL PROOF (via full copy of all tests done by a recognised lab) that the product meets the applicable EN Standards and EU Directives. This file is less bulky only if the lab is a "Notified Body" (which are a select list of labs directly appointed by EU Governments to test for CE conformity). 

The purpose of holding this TC File on EU territory is to enable any EU Government to inspect it at any time. That file must be held for at least 5 years after sale of the product ceases in EU and, as I said, it must contain absolute evidence that the product is lawfully able to bear a CE label. The CE certificate of comformity is just a bit of paper at the front of the big TC File setting out the applicable EN Standards and bottom line results of lab tests thereto.

You must ask your supplier who is its Authorised Representative to hold the Technical Construction File in EU and you must check that this Rep in fact holds the TC File.  If you import into EU but the manufacturer has no Authorised Representative holding the TC File, EU law then deems you, the importer, to be the actual manufacturer and that you yourself must therefore hold the TC File.

In other words, a CE certificate of conformity is of itself useless unless either the Authorised Representative of the manufacturer OR the importer holds the highly technical TC File on EU territority for any EU Government to inspect at any time until at least 5 years after the product ceases to be sold in EU. This file must absolutely evidence in highly technical terms, typically running into 100 to 200 pages, that the product complies with EU Directives and EN Standards.  If that file does not exist on EU territority then you, the importer, automatically breaches EU law and your product is liable to be recalled at your cost from whoever you sold it to.

Bottom line ... a CE certificate of itself is absolutely meaningless and gives no right whatsoever for an importer to sell products in EU bearing a CE label. The right of an importer to market products in EU bearing the CE label arises from the Technical Construction File held on EU territory. No right to sell product under a CE label arises from merely holding the bare CE certificate of conformity.

However, that process is much easier if the test lab is an EU "Notified Body" lab. Only Notified Body labs have a "CE number". Therefore, ask your supplier if the Dutch lab is a Notified Body, and if so, what is their CE number.
