Ripped Off $350,000 By A Compony
[em4] What can I do about a China company that ripped me off- I sent them over 350k US Dollars and have not received about 70k of goods- Any help will be greatly appreciated-

  1. How did you transfer that amount of money?
  2. Who did you have check out the company?  (SGS) (INTERTEK) ect..?
  3. Did you have a formal contract with the company based on Chinese law?
  4. Did the above contract address rememdies for breech of contract under Chinese law?

First off for that kind of money, its amazing that you did not personally visit your supplier.

I visited the supplier 3 times- twice before I wired $ and once afterwards to check production- as mentioned the funds were wired on a series of dates and amounts-

Ok, so you did the checking yourself, but did you have a legal contract enforceable in the Chinese courts.  The CISG is very specific about what constitutes a contract.  If you recieved a Pro Forma invoice that clearly stated that acceptance of the offer could only be confirmed by means of Telegram or Telex and upon remittance of payment. 

It would be concluded that there was no offer of acceptance by the buyer.   That means if you only sent an email saying that you agreed to the terms of the Pro Forma no contract exists until you have sent your acceptance by the means of Telex or Telegram.  It wouldnt be the first time someone or some small company has been satisfied by the supplier for small orders until such time the one that will break your business is paid for and then the supplier dries up. 

Without knowing all the details its hard to tell you what you can or cant do or what legal recourse you may or may not have.

Lawyer He over in the Legal forum is an astute commercial lawyer with whom I've had a couple of private dealings. He's based in Beijing. From memory he charges about $150 per hour which is the norm. I haven't been to that forum for a while but I trust he's still there. Broadly, from a cost perspective, you are better off with a good mainland lawyer rather than a Hong Kong based one.

I can only speck for my self, I also have a case going on in , we have now simply given up to take legal action against the company who tog our money and engage a team specialized in collecting money

So many people are being ripped off or scammed. This is not good for business neither for China nor for anybody or Alibaba. I've been ripped off too and yet nearly all the alert are from scammers. So how find a solution and banned this kind of pratice. I want devellop a system to allow overseas traders to hire our services so that we could avoid all bad surprise for them. But still scammers will continue to hunt in the jungle. So if its really a jungle, I should say to all scammers that will cross our road, that death or something similar could rise to their face. If they think that they are smart, I know so much people living next to them who are ready to fuck them hard. By this mean every scammer should know that they will no longer peacefully  do what ever they want. Its more than a warning. Its a promise coming soon.

Well there is one thing that can be done if you are purchasing from the United States you can hire a company like us to go over and investigate the issue and see what the problem is and try to getting some of the money back or get your orders. Replying to [macsourcingBewildering that you imply that your a company in Hunstville, Alabama and on your website called "Mac Sourcing Inc." when we both know that your not.  Nor are you a company called the "The Mitchells Company".  Don't you think that anyone is going to check into the authenticity of your claims?  I bet that you didn't even realize that since I just put both names in quotations that now there is a direct link to this post and your websites.  Anyone searching for your company name can be linked here.
