I am a reseller from Germany and I got decived from:

The manager of this company is Mr. Steven Sun.
According to an order I placed, I recived an Invoice and made the payment.
The stuff this company sent me was completly different to the stuff I ordered and payed for: this " " wasn´ t worth half of the money I payed.
This company / Mr. Sun did not want to take the " " back and kept my money.

I also asked the German Chamber of Commerce to investigate against them.
As follows I post the detailed circumstances:

Delivery of Quads ATVs



Dear Mr. Sun,

Today, Mr. Semler (videostarsupport@aol.com) has approached us, the Delegation of German Industry and Commerce in China, with the request for assistance regarding a dispute with your company.
As we have been informed by Mr.Semler, a problem has occurred with the quality of 200 ccm ATVs that were ordered from your company on the 21st of March 2007.  

Mr.Semler informed us about the following case:

In December 2006 Mr.Semler ordered 15 ATVs at the price of US-$ 685 each.
On 17th of January 2007 your company informed him that some improvements were made on the 200 ccm ATVs and offered a "new" model for the price of US-$ 748,-.

Mr. Semler informed us, he also ordered one of these "new" ATVs.
 
All the ATVs Mr. Semler ordered were 200 ccm-models.

From this time on, you named the different 200 ccm models "new" (because it was improved recently) and "cheap" (because the price of US-$ 685, - is cheaper than the price of the "new" one which costs US-$ 748,-).
According to our information you delivered them in February 2007. Mr. Semler got an individual "COC-document" required for the use on public road for each ATV. On these COC-documents all the ATVs were listed with 200 ccm. In the order of December 2006 Mr. Semler said, he ordered only black ATVs but he said, he received different colors as well. He kept the ATVs anyway.

In March 2007 Mr. Semler planed to order again and therefore asked you to confirm the prices of the 200 ccm ATVs. According to or information you informed Mr. Semler that there was a little price increase and the new prices for the 200 ccm ATVs were now US-$ 693,00 for the "cheap" model and US-$ 765,00 for the "new" model.
Mr. Semler also informed us you then sent him a new price-list.
The model "HSATV200C-2" at the price of US-$ 768,- was the one you both called "new" and the model "HSATV200c" at the price of US-$ 695,- was the one you called "cheap".
These were the same models Mr. Semler received from your company in February 2007.

Mr. Semler wanted to make sure that the ATVs he planned to order in March 2007 are exactly the same models he received in February 2007. So he said, he asked you: "Would the models be the same like the ones I got...". You answered: "Yes, same models...".
In Mr. Semlers` order dated 21st of March 2007 he stated again (although absolutely unnecessary, because in his opinion you both had never talked about different ATVs): "All ATVs 200ccm same models like last time ...”. He said, he ordered 22 ATVs with 200 ccm.

On 23rd of March 2007 Mr. Semler received an invoice for his order. According to our information the prices stated in this invoice were identical with the ones in the price-list and corresponded with the models HSATV200C-2 at US-$ 768, - and the model HSATV200c at US-$ 695, - and were as always named "new" respectively "cheap" models.

In accordance with the invoice, payment has been made by Mr. Semler on 26th of March 2007 and he informed you the same day.

On the original invoice dated 7th of May 2007 all vehicle identification numbers (= VIN) of the ATVs you sent Mr. Semler were stated.
He said, he got an individual "COC-document" for every ATV and noticed on the reverse side of the document that only 110 ccm ATVs were sent by your company.

Mr. Semler has the opinion, he had never ordered 110 ccm ATVs. Besides this, he thinks they have a much lower value than the ones he ordered and paid for.
According to your price-list these 110 ccm ATVs have the model number "HSATV110C" and the price is US-$ 535, - each.

He said the 110 ccm ATVs are almost worthless for him. In Germany it is just about impossible to sell 110 ccm ATVs, as Mr. Semler thinks, because the vehicle weight is 150 kg and the ATVs have only an engine power of 5 kw. According to the information we got from Mr. Semler, there is absolutely no demand for these models in Germany.

As he never ordered 110 ccm ATVs Mr. Semler asked you if it was again a mistake or if you and your company wanted to fool and deceive him.
"Again a mistake" because with his previous order he also received ATVs differing from the ones he ordered. He ordered black ATVs and got blue, red and black ones.

In case of a mistake and to settle this manner Mr. Semler already suggested the following possibilities to your company:

1) He will arrange to have the container returned to China after your company transferred the money back to him

or

2) Your company pays Mr. Semler the price-difference between the 110 ccm ATVs and the 200 ccm ATVs back, which is US-$ 3.895,-.

Mr. Semler had several times asked you to regulate the problems but there have been no further reactions from your side. The total correspondence and all the documents are now in the hands of the GIC and we would like politely to inquire, how this problem can be solved quickly.

We expect a reaction from your side within the next 10 days otherwise this case will be handed over to a Chinese law office to file a complaint by the court in charge.

We made the experience in the past that many Chinese companies have very good relationships with their German contractual partners.

We would really appreciate your co-operation in this matter, as cases like this seem to be troubling for the German-Chinese business relations. In order to maintain the good relationship, we would politely ask you to contact Mr. Semler directly and solve this matter as soon as possible. It is always better to find an amicable solution than to start juridical proceedings.
