Begin to Sign the Contact, but Can i Trust this Guy?

I am looking to import agricultural chemicals. His proposed buying procedures are as follows:

1. Buyer issue LOI
2. Seller issue FCO thru me
3. In case accepted, Buyer to issue ICPO + BCL
4. Seller to issue contract for signature
5. Upon signature, Buyer will open DLC or SBLC
6. Once Seller's bank receives notification of DLC or SBLC opening, they will send POP + 2% PB to Buyer
7. Approximately 30-35 days after receipt of valid DLC or SBLC shipments will begin.



The problem lies in step 5. If we open DLC and SBLC then he send us the POP and PB. Is that gonna be a problem if i follow his procedures or am i being paranoid? If this procedures proves to be unsecure how should i modify it to protect myself from scams? Many Thanks

Hi Eddie, I'm not sure I understand your role or why a buyer would issue an ICPO before sighting the Contract. However, every case is different but as buyer I'd likely request here:

1. Seller to issue FCO/Contract for my review and negotiation as to terms if necessary (I would not send LOI or ICPO before sighting the Contract).

2. I then send LOI/ICPO.

3. Seller sends POP and non-PB.

4. I issue DLC to trigger PB.

5. Delivery.

Contract is conditional upon issue of import permit for subject chemicals, among other.

Inspection must be by SGS or similar substance.

I have very serious problems in dealing with Chinese suppliers who dont honour their committments at all-They make firm committments and once they get orders and lcs they back out on one pretext or the other-thereby I have to incur big losses plus lose my reputatations.D you have any comments in this regard
