What Could We Do, Any Ideas?

Dear everyone,


We are manufacturer in China, our company was built in 1993. We produce all kinds of oil purifying and recycling equipment to treat different oils.

We are the earlist and best in the same field in China. But too many other small companies often copy our products and advertise them by internet. Too many customers from overseas contact them and trust them, even place order with those companies.

Why? how can we do now?

I think most of the products are copied by each other then have some changed or upgraded. Maybe at first you copied from others too when you are green.[em2] You can set up your brand and apply the Patent Right and take the legal action to prevent they use your brand.

In fact, many famous brands's products are copied the design by others, but the brand is different...

You cannot stop copying, but you can protect yourself...[em1]

We are trying our best to protect our properties. But one problem is that there is no obvious or specific regulations to control and manage this industy.

Replying to [henryhe]: It is very normal In China now. In fact, no one dare to copy famous brand to export. So I think the best method is creat a truthful brand for your factory. Brand is brand. [em1]

Try contacting your old and new buyers and alighting them to the danger of your "copied products".
Customer follow-up is important,even when he bought for 1 USD.

Replying to [henryhe]:Firstly, Which market are you target on? North America, Western Europe, Australia, Asia Japan, Middle Asia or Southern Asia, Africa, India??? (Just think about it)

1) North America, Western Europe, Australia or Asia Japan Market -
you may try to register a patent for your products, which aimed to prevent the buyers buying non-license products. Which may help a little bit to your business.

2) For markets in Middle & Southern Asia, India, Africa - please forget the patent, it is useless, the only way is to try your best cover most of the market share by providing your lowest price, best quality, newest products range instead of wanna to stop copying. The fact is who care who designs the products in those regions...

Finally, you don't want somebody copy your idea, try to make your product in secrets, only serve existing customers for your new idea, remember to remind your clients not to disclose your idea to anyone else.

that is...try your best...

I am glad that you raised this problem in this Forum because you are a Chinese and facing copyright problems.I feel sorry that you have this problem.In this Forum I want to say something which you may not like but its true:

1) China is the capital of Copyright infringment and illegal trade of branded
goods.If one your own is copying you..you can well image how foreign
co feel about their products being copied.

2) This problem occuring in China is good in a way because now you will
find a way to stop it which will have a good effect oevrall for the
industry.

3) Some products by its nature cannot have protection and your product
is such that there are ways to by-pass laws.
If your product does not have value for money or you are charging too
much or yr quality is low you can do nothing.

In todays highly competitive market you have to be smarter in
positioning your product.Many people today do not want to
buy cheap low priced product from China.

Since you are reaching out globally, online advertisement with creditable, information website is the best way to gain confident of Buyers by:

1) Patent your trademark

2) Obtain your clients approval especially from the welknown established Buyers to have their positive testimonials on your website on: products quality, service (before and after sales), crediblity and etc.

3) Besides providing your Company profile, if possible with your big Boss (CEO or Managing Director) and the factory pictures on website.

4) If any, picture of your Company's partcipation of trade exhibition.

5) The certificates you obtained.

Good Buyers don't mind a slight different in prices as they are more far sighted and prefer a good long term business relationship.
