How can I file a lawsuit against Xiamen Buyerlong Import & Export Co., Ltd. company in China. I had purchased an LG KU990 Viewty phone for $244 with Memory card and they sent me a FAKE Nokia N95 and refuse to talk with me. I have patiently waited for a response they claim was a mixup in deliveries..but its going on 2weeks. Before I sent them payment and was in the process of purchase I was getting e-mail and Instant Messages from them everyday, now no one wants to speak with me. This has been very difficult for me, being the first time it has happened and I spent my hard earned money.

One vital part of a law suit is being able to identify and locate the party you are suing.

My guess is that you made payment via western union to an individual in China who most likely gave you a fake name to collect that money. I also assume that you have at most a website address, free email address, and perhaps a mobile phone number which is likely one of those disposable numbers available here in China.

My hope is that you did your due dilligence BEFORE you made the payment and that you have verified the contact details that they gave you.

If not then you won't have much chance of getting your money back as no one will be able to find them!

Replying to [Pebbles9984]:Egernia, told you right. The fact is no lawyer will take your case in China without you retaining them at a far greater expense than what you paid.. The fact is you will spend more on lawyer fee's then taking the loss.

Another thing, if you wanted only one why would you take a risk in buying it from another country when clearly if you did a little homework you could have bought one in the U.S. Electronics run in cycles when phone sales are down and the manufacturers wish to move stock they simply rebate the phones. Without any trouble I found a reliable retailer in the U.S. selling them at 325.99 after rebate with free shipping.

I fail to understand why people think that they can get name brand items so much cheaper in China then they can at home. Surely you don't think that profit margins are so high on electronics that you would only have to pay 50% of retail to get a real phone?

Last but not least you paid by Western Union. For all you know the person that recieved your money could have been living in the same town your in. Maybe you were even told to send the money and hold the MCTN# until you recieved the phone at which time you would forward them the number. That alone is a hoax. MCTN# has nothing to do with the transfer and who picks up the money or even where in the world its picked up.

Alibaba is supposed to be a world trade platform not a world retail platform which is what it seems so many westerners seem to think it is. Scammers wouldn't be here except that they know that people will not check references. Alibaba is not an Ebay surrogate. Alibaba also makes no claims that you will actually recieve what you paid for from any of the advertisers. Before you bought anything from anyone on this site you should have read the terms of use policy that is clearly linked to at the bottom of every page.

Replying to [Pebbles9984]: Thanks to all the replys. I should have been more careful in purchasing my phone. At the price that was given, it was too good to be true. I should have looked into the company in full detail, between working and going to school, I just purchased what sounded good to me without taking percautions. I got scammed...what a lesson learned.[em4]

Replying to [Pebbles9984]: Not a cheap lesson for a college student, but it is better than having lost thousands of dollars. Like you say next time, and or if you decide to buy products internationally you will be much more aware of the process that needs to take palce before you actually send your hard earned money.[em19][em15]

Loss of your hard earned money might be just the start of your problems.

If you use that phone for about 10 minutes and feel the flesh in your ear getting "warm", it means the phone is giving off excess emissions causing hot spots in your brain tissue. You can't feel the hot spot in your brain tissue but you can feel it in your ear.

I know those fake Chinese Nokia 95s pretty well. They wholesale for $40 in China and do not pass SAR certification tests which protect consumers from excess emissions.
