A company in China using our photos in their website

Hi there,

What can be done to stop a company in China downloading our photos in our website and using it in their website. It's very unfair that we spend a lot of money to take photos of our products and another company just use them in their website in ALIBABA.

Dear Ygorot,

First, make sure products in those photos are yours. It is the basis of your claim against them.

Second, please make sure you are the rightful holder of the copyright of those photos. Sometimes, it is not the employee of the company that take photos of its products. If not, it is neccessary for you to obtain exclusive license from the copyright holder before you claim gainst the infringers.

Third, if the above is cleared, you may send demand letter to them demanding them to stop using those photos. If they continue, you may consider legal action.

But before doing all the above,  save copies or photocopy those ifnringing webs as evidence, which I suppose you will do.

Thanks a lot for your comments.

There is a company in Xiamen, China who manufactures our products. We pay all the moulds and tooling charges and we have a verbal agreement that they won't sell these products. However, we just found out that they have downloaded some of our photos in our website and used them in their website without our knowledge.

I think this is stealing and we want legal actions against these people. For some products, they made small changes but they are still using our moulds to make their own products. Is there a way to stop them or asking Alibaba to remove these photos from their website in Alibaba?

Replying to [Ygorot]: I will let He deal with the leagl issue for you..

On the issue of copyrighting your photos: it is almost impossible to stop people from doing what you have said here.

The easiest way to stop it from happening again is to watermark your photos. It is not difficult to do if you have a good graphics application.
