Replying to [curdrice]:Brand is a name you give to a product you sell to identify as your product. Brand becomes a trade mark which can not be copied, through registration with Registrar of trade marks, and can not be copied. Trade mark is available for different categories(In India, there are 34 categories), registration for each category is required, otherwise it can still be copied. Examples Rexona soap and Rexona Hawaii Chappal are different categories. No one can copy Rexona soap but Hawaii chappel is different category, hence can not be stopped. Same for Amul milk products and Amul undergarments. USHA brand, famous for Fans, Sewing machines is used by another bicycle tyre company, who won a case against Usha fans in Delhi High Court. Similar sounding names can not be used, under passing off of registered trade mark. COLGATE can not be copied by similar name like callgate, colgeate etc for passing off offence Sixer
