Has anyone been successful in suing a supplier China? How long does it take and do you think it was worth the time, effort and money.

It seems that companies in China can send you defective merchandise without any recourse even if you receive a guarantee letter stating there was no defects. It seems to take a lot of effort plus money to sue these companies and there is no guarantee you will receive any money from your lawsuit.

Recently, I have helped a client in Poland to recover damages around USD 215,000 from a company in Guangdong province.


The case was brought to court in Feb.2007, and the company remitted the money to my client in June 2007, so only five months were cost in this case.


However, five months is the shortest time I have seen in international lawsuit to go through the whole procedure. Nearly 70% of the international commercial lawsuit cases I have handled last 13 months to 20 months in Guangdong province. As Chinese laws provide no time limits for international litigation within which time a case must be finished, most such cases last much longer than civil cases.


Sometimes you win the case but lose the money, because the defendant has no enough assets to pay his debts, especially when the defendants are small companies or false companies.


As I see it, when deciding to reach an agreement with any companies, you must need to know their real background. Because, for the worst, when disputes happen, they have the ability to compensate. Resorting to local lawyers is the best way.

It is impossible to estimate a standard period for all the supplier cases. Our firm has handled some cases that have taken several months to several years to reach  conclusions. It depends on both the attitude of the supplier and the complicity of the case.


The luckiest clients may need to pay less than USD 2,000 as the supplier will settle with them when the supplier receives a demand letter from a lawyer. However, some clients need to spend more than USD 20,000 if litigation is necessary.
