If Seller made a Mistake, who need to pay? buyer or seller?

Hi Guys,
If a seller sends the wrong goods does the buyer have to send back the goods at his cost to the seller?
The reason for the question I ordered a Apple iphone from a supplier/seller and they sent a fake N95 but they asked me to send back the n95 before they would refund me.I am sure they are scammers. I Was wondering what the rules are reagrding this issue.

In your case , my suggestions is not to send the N95 back . If you send the N95 back , you will get nothing finally . I am pretty sure that your supplier will not refund you after you send back the phone .

For the brand name stuff , pls contact the authorized agents or distributors . You will get illegal fake or scammed through other channels here .

Let this be one lesson for your business in the future .

Read ALL the postings made about fake iPhones/ N95's etc. Noone can be selling you these. They are fakes or refurbs at best.......... Cut your loses.

Standard would be that the seller is responsible as it is their mistake, however you are dealing with fake products from scammers.

you should probably just chalk this up to a learning experience.

for your Question ,i think you don`t need to send goods back it at this moment .i think it would better to know well about your supplier .first ,how about your supplier ? it one of gold member on alibaba ? if yes ,you can send back to them and all fee they will be pay it ! if is not .don`t sent back .
