Buyer claims goods damaged upon delivery.  They were well-packed.  He refuses to pay.  What can I do?

The best thing to do is to seek juridical party , I suggest to choose your Embassy at their country plus specialized committee from their Chamber of industry and commerce , of course the result of the report should be submitted to the insurance company , and shipping company to determine the responsibility for each party. Replying to [Admin]:Hello! You should tell your client that your responsibility includes only organization of the delivery. You have organized the delivery and checked goods packaging. These should be mentioned in your contract or agreement. Tell your client to pay for your services and that you will help him with his problems. Who is responsible - company who made delivery.[em18]

Replying to [Admin]:Replying to [Admin]: If buyer say goods damaged and refuse to pay. you should ask buyer to inspect the goods by any international standard inspection company like SGS. if the goods are really damaged the buyer should claim to the shipping company not you.
if shipping company give you the clear BL in that case shipping company should take the claim. but normally the buyer try to hold the payment of the supplier. if inspection shows the damage is done
i think you should negotiate with the buyer and settle the claim immediately and take the payment. if you delay you will lose more money.

[em2] Well, jokes apart

It is always better to have a secured payment terms i.e. advance TT or Bank L/C. You please ask your insurange agent & if the buyer is at fault you can complaint about him to the Govrnment Authority i.e. Embassy or Commercial attache.
Else you may need to talk to buyer and ask for the alternative beacuse calling goods back may be a costly affair.
Think for all repurcussions and then decide and take corrective step.
Also give a thought to preventive step as I indicated in the first line.

i suggest you ask him to take photographs of the damaged goods and see if you can tell from the photographs if they are actually damaged. If you cannot tell, ask him to send you 2 or 3 samples so you can examine them yourself. If you are an exporter and the samples show they are defective, you should go to the factory and try and claim back from them. If you are a genuine factory and want to continue business, they should somehow accomodate you. In future you should randomlt inspect goods before they are shipped. I suspect you are giving credit to this customer. i suggest you aviod credit to customers in future as they are alot of dishonest buyers out there.

First thing if you are dealing with anyone but natural you must be having contract signed by you & your buyer just incase if buyer denies to pay you if you have sent goods as per mentioned in contract then according to ICC law of paris if you cannot sort out things by negotiation you can file a case on him in international chamber of commerce or hire a lawyer for you who has good knowledge of import & export trade activities.
