Anyway, his msn messenger is the same as his email address which is chenfanone@hotmail.com in the case anybody wants to help me get my moeny back. My anme is valerie from usa and he know me well. He shorted me over 500 pieces of von dutch clothing...Only other problem i have is when things get locked in customs...which it has happened more then once comming from china, the people i work with offer very little help clearing customs and also did not offer refund and shipping was VERY expensive for me just to have items siezed by customs. Thank you cbeebies,

people like you makes the trading safer. Let me share my part to help someone here in my homeland.

Thomas a swiss national placed order for 10 sets of Sony PSP at a low price of US$2600.00 ($260 a piece) from a firm who advertised in Alibaba Website. This was in January 2006, and the guy named Mr. Choo, delivered 5 sets on the first deal, and said they ran out of stocks and promised to back order and deliver the other 5 within next 3 weeks.

Thomas was happy with the first delivery, and he ordered another 10 sets, paid upfront US$2700 by telegraph transfer. After 4 weeks the goods never arrived and another person by the name of Roger Lee took over the communications and told Thomas that the firm declared bankrupt.

I did a committment to help Thomas as he contacted me over the chat room, and I did. Good that Thomas sent telegraph transfer with the records of the beneficiary and the firm's name in the wire form. Thomas sent all the evidences to me, I went to the Singapore Registrar of Businesses and did a search and found the company still active and has changed name. I went to the address of the business and found the shop closed, while the neighbours are opened.

The latest part is: I made a police report and sent it to Thomas along with the report from the Business Register. Thomas will be sending a letter of warning, pleading to the culprit to refund the money within a deadline of 2 weeks, if not we (me representing Thomas) will take them to the Subordinate Court for legal action.

StreetSmart, thank God people in Alibaba have you there in Singapore (although I think cases like this would be very rare in Singapore really).
PErsonally I think the case you mentioned is not really an absolute fraud case (but hey I'm not an expert in law field, so I could be wrong).
I'm just curious, will this case fall into criminal charge or civil lawsuit (according to Singapore law)?

Replying to [trado]:Yes trado, nice to see you back.

This case is considered as a Breach of Agreement. An agreement or contract can be formal or informal, like a sales agreement, with a quotation and an order given within their stipulated terms. The seller fails to deliver the goods and did not keep up to his promise to refund the money... which is a criminal act.

Replying to [cbeebies]:If those scammers think that nobody's going after them and they can get away with the crime, there will be more people joining them in the ranks.

The only way to get rid of dirty business is to prosecute them, and bring them to justice... to make sure that they pay for their crimes. Good will always triumph over evil, and evil doers shall not prosper.[em31]
