How can I Recover Deposit Money ?
Post 72 of 78

Quoting from [sammy_sung]:

I placed an order with a Chinese company back in March after visiting the company. I was given some preliminary samples at that time. I then sent them about $9000 USD as a deposit. The manufacturing process went very slowly and they finally sent a second set of samples about 3 weeks ago. The products were terrible quality.

I am not willing to accept these products and have demanded my deposit back. They told me that they can return the money in 1 year. I told them that was unacceptable and have not heard back from them in 5 days. What steps should I take to get my money back?

I am also a buyer and that happened to me once. I cannot suggest you how to get the money back because I didn't get it back. However, what I can do is to tell you what I've been doing since to avoid that to happen to me again.

I'm now working with China Quality Partners and when I order something I hire their services. It is a company dedicated to helping overseas buyers reduce risk and improve the quality of the goods that are purchased from China. They inspect the goods at the point of production and keep me updated on how the goods are being manufactrued.

Take a look at their website: www.chinaqualitypartners.com . Also, they have a great customer service and the sales girl is very nice.

I hope this can help you for next time you want to buy from China

fiist, you are so carefulnessless that you could send a deposit ofUSD9000 without the agreed contract in advance. from some scale, sincerely speaking,it owes to your  less knowledge of the basic business rules.

second,  i have to tell you that  legal cases involved  in foreign trade is very comprehensive and tough,so you 'd better change  your mind not to appeal for law assistance .now ,i offer you a idea for your reference that you can make some concession to increase the unit price of your ordered goods and decrease the total quantity  accordingly  on the condition that the seller in their place must improve the quality.as for the scale of  the increased unit price, you can negociate with the seller.wish y good luck!

wish good for you !

Unfortunately, this is a scenario which happens all too frequently. The main basis of your request for return of deposit should be the terms of your Sales/Manufacturing Contract, which should define the situations in which you would be entitled to return of your deposit as well as the specific length of time in which the non-performing party must comply. However, if you have not signed an agreement which contemplated such events (and even if you have and the other party is not replying/complying), the next step would be to collect all the evidence that you have with regards to the transaction and catalogue. Then, generally with the assistance of a local attorney, send a warning letter (including list of evidence) demanding return of deposit under threat of suit. This may or may not result in the other party re-commencing negotiations. If it does, then handle from there. If again there is still no response, then you would have to decide whether it was economically feasible or desirable to commence a legal action against the company for return of your deposit.

for such problem, seems difficult to get money back, the problely you can do , is stick factor y for quality sample , order some from then, change your deposit into 100% payment advance. in this way , can help you reduce lost. otherwise it will take you long time and even more cost to have money back. what you think ?
