Replying to [sammy_sung]:As I always say in my every forum that china sell the worst quality product , they will send a good quality sample but they cannot send good quality of goods So be carefull All buyer and importers of diiferent countries. As far as Payment matter Just call the china embassy people in your country or mail them.Mail them all correspondence betwwen china seller and you Mail them china seller Account number and full address also .They will contact their country govt official and try to get your payment back but keep in mind this is long process and one thing more they black list the manufacture also which take your payment and does not send good to you

Replying to [sammy_sung]: The quick answer is you cannot recover the money. It is not because of legality of the contract, but how the Chinese system works.

Many factories are in close tie with the China goverment officials and in China both making law and enforcing law are in the hand of government officials. Unlike the U.S. in which the Court systme is separate and distinct from the legislatives.

So even if you sue in China, the case will never be heard. Because the people in charge of the case is the same group of people that are tied to these factories.

Of course if you have signed contract with the factory, by law, the company is bounded to return your deposit as per the contract terms dictates. However, that is true only if your case will be heard from a Court of law. If your case is never heard in front of a judge, then how can the law matters.

Having said that, China government is usually very responsive to complaints from foreigners. Ah if you are not a citizen of the Great China, i.e. Taiwan, China, Hong Kong, Macau, then you are in a much better position. The fact that you are a United States citizen gives you supreme power. China is very response to pressure from the U.S.

File a complain to the U.S. Embassy in China and the China Embassy in your country and may be you will get your deposit back and more so that it will not rise up to an international matter. Ah probably you will get the money in 2-3 weeks at most.

If you haven't done it already, I strongly recommend that you do.

But this all holds if and only if the company you buy from is a registered company in mainland china which has a fixed physical address. If it's a ghetto run by scammers and the company don't even exist then no one can help you. They might already be running another joint using a different company name already.

Sorry for you ! I myself got same trouble with you, I was cheated twice, one from Bangladesh supplier (shipped short quantity and bad quality) and one from Russia supplier (deposited but no shipment !).

Who can help me to recover my loss and fund ???

Although I can't assist you to recover the deposit but I have some points to mention.

Alibaba as an owner of this site to match buyers and suppliers should list out who these default suppliers are to prevent these black sheep from damaging the serious suppliers.

Buyers who encounters default by these suppliers should immediately report such cases and name updated to Alibaba management. This will allow any buyers to check which are the black sheep and banned before starting to negotiate for any business deal.

The effects, I am sure:-

- will filter out the conned men
- improve the quality and purpose of Alibaba
- improve the image of the Chinese traders

Prompt action should be taken fast to ban all these traders.

Why i am writing you because with search on this refund of money i was serching and got your subject by luck.

We have by mistake remmited USD 19,000 to a company in Yanzhou and today have got refund from them.

What i found from your point is that your presence is not in china so the chinese company take advantage of it.
We have office in shanghai. and when we found we made remmitance to wrong company we first asked our bank to send a swift message for the refund of this money.
in such case the money cannot be used for trade purpose as it is for refund purpose. you need to explain to the bank the reason.

Now once this is done you need to go to the foriegn exchange department of the particular bank in the same city and discuss in the VIP section and they would ask you for the following set of documents.

certificate of the deposit in which on plain paper you need to make the detail of the beneficary company.

then a letter stating the cause of refund. and the transaction detail..

once this is done need to submit in the department of foriegn exchange and they would contact the company for the refund and they have to refund back the money immediately.

I think you should consult with a lawyer who's in Chinese law.

And then try to sue them. Cus you are dealing with scammers.
